The 2026 Edition of the Pocket Ontario OH&S Act & Regulations reflects all legislative amendments gazetted up to Ontario Gazette 158:52 (December 27, 2025).

NEW THIS YEAR

Legislative and Regulatory Changes:

• ·Changes arising from the Working for Workers Seven Act, 2025, including:
  • Administrative Monetary Penalties, under a new Part IX.1 of the OHSA (in force as of November 27, 2025, with associated regulations to follow).
  • Section 7.6.1 of the OHSA: accredited health and safety management systems to be treated as equivalents.
  • Automated External Defibrillators: The OHSA (section 22.0.1) is amended to provide for reimbursement of some defibrillator costs. O. Reg. 213/91 (Construction Projects) is amended by adding a new s. 27.1 (Defibrillators).

• Changes arising from the Working for Workers Six Act, 2024, including:
  • Minimum $500,000 fine for a second or subsequent offence for corporations
  • Roadside Safety: Changes to s. 159 of the Highway Traffic Act aimed at enhancing safety for roadside workers.
  • Proper Fit for PPE: Amendment to Section 25 (1) of OHSA to relating to proper fit of PPE in all sectors (not just construction), particularly for women and workers with diverse body shapes.

• Review of changes arising from the Working for Workers Five Act, 2024, including the stipulation that the OHSA applies to remote work, provisions relating to virtual workplace harassment, requirements relating to electronic posting of the OHSA and other information, virtual Joint Health and Safety Committee (JHSC) meetings and with respect to washroom facilities.

The Regulatory Update Also Includes:

• Select case summaries of OH&S prosecutions.
• Review of regulatory changes in 2025 and forthcoming in 2026.
