In this edition we include two important enactments of the British Columbia legislature.

 

The Haida Nation Recognition Act, SBC 2023, c. 24, together with the amendments to it found in the Haida Nation Recognition Amendment Act, 2024, SBC 2024, c. 23, appears to be the first time that a provincial legislature has attempted to recognize Aboriginal Title by legislation.

 

Also included is the interesting amendment to the Land Title Act found in the Land Title and Property Law Amendment Act, 2024.The legislation provides that "A First Nation has the power and capacity of a natural person to acquire and dispose of land in British Columbia". This corrects a long-standing difficulty faced by British Columbia First Nations, that they could not register title to land in the name of the first nation itself, and instead found it necessary to utilize trusts, corporations, and other legal devices to acquire title to fee simple lands off reserve.
