The federal legislation is current to S.C. 2024, 34, assented December 17, 2024, up to and including the Canada Gazette volume 159:12 (June 4, 2025). The provincial legislation is current to S.O. 2025, c. 2 assented May 29, 2025, up to and including the Ontario Gazette volume 158:22 (May 31, 2025).
New in This Edition:
- Subrule 1(8)(a.1) of the Family Law Rules was added to expressly permit the court to order fines or penalties absent a finding of contempt.
- Subrule 1(12.2) of the Family Law Rules was added to address out-of-court communications.
- Changes to the following forms:
- Form 37 Series (Forms 37, 37A, 37B, 37C, 37D) from the Interjurisdictional Support Orders unit within FRO were made to reflect implementation of a new Hague Convention for support in Ontario; and
- Form 8A (Application for Divorce) to add wording about whether the applicant was habitually resident in Ontario for at least one year prior to commencing the application; and
- New Rule 43 of the Family Law Rules was introduced on Binding Judicial Resolution in the Superior Court of Justice.
- Changes were made to the costs provisions under Rule 24 of the Family Law Rules
- On December 4, 2024, Bill 227 received Royal Assent in the Ontario legislature. Pursuant to Schedule 9, a new provision has been enacted designed for easier enforcement of support provisions made by family arbitrators. New s. 59.9(1) of the Family Law Act provides that a party who is entitled to the enforcement of a family arbitration award that contains a provision for support or maintenance may file the award with the clerk of the Superior Court of Justice or the Family Court together with a copy of the family arbitration agreement and copies of the certificates of independent legal advice. The provision has yet to be proclaimed as the Ministry of the Attorney General is working with various constituencies (Family Law Rules Committee and the Family Responsibility Office) to create a standard form and arbitral award.
